Pravilnik i uslovi koje moraju da ispune kompanije koje se bave Flight Planning-om, Dispečerski centri

Kojim pravilnikom su propisani uslovi koje mora da ispunjava organizacija koja se bavi planiranjem letenenja, dispečerski centri?

Naime, postoje firme koje se bave samo flight planning-om za druge kompanije. Da li te firme moraju da imaju samo sertifikovane dispečere ili se nekim posebnim pravilnikom regulišu obaveze i uslovi koje moraju ispuniti?

Vaše pitanje je zaista interesantno i pokušaćemo detaljno odgovoriti na njega.

Svakako je moguće da operater ugovori usluge koje se odnose na planiranje letenja. Medjutim, nedostaje podzakonski propis koji razradjuje uslove koje mora da ispuni takva organizacija.

Suštinski je flight planning deo OPS regulative, koja je delom preneta u srpske propise, a sa većim delom koji nije prenet se kasni iz nama nepoznatih razloga, mada je to obaveza Direktorata i razloge verovatno treba tražiti tamo.

EASA PART-OPS (965/2012) kaže sledeće:

ORO.GEN.205 Contracted activities

(a) The operator shall ensure that when contracting or purchasing any part of its activity, the contracted or purchased service or product conforms to the applicable requirements.

(b) When the certified operator or the SPO authorisation holder contracts any part of its activity to an organisation that is not itself certified or authorised in accordance with this Part to carry out such activity, the contracted organisation shall work under the approval of the operator. The contracting organisation shall ensure that the competent authority is given access to the contracted organisation, to determine continued compliance with the applicable requirements.

Pod stavom b) možete videti da, u slučaju da ugovorena organizacija nije sertifikovana po PART-OPS regulativi, takva organizacija mora da radi u skladu sa sertifikatom i pod uslovima koji su odobreni u sertifikatu operatera (AOC, SPO authorization – kod nas poznat kao AWC) za koga pruža uslugu. Nama nije poznato da postoji propis kojim bi se sertifikovala flight planning organizacija/provajder usluga.

To u neku ruku znači da takva organizacija mora biti legalni privredni subject, sa propisno kvalifikovanim osobljem, tehničkim sredstvima i odobrenim sofverom. Međutim, sve procedure rada unutar nje, koje se odnose na neku kompaniju kojoj pruža usluge, treba da su regulisane operativnim priručnikom tog operatera.

U AMC i GM smernicama se kaže sledeće:

AMC1 ORO.GEN.205 Contracted activities

RESPONSIBILITY WHEN CONTRACTING ACTIVITIES

(a) The operator may decide to contract certain activities to external organisations.

(b) A written agreement should exist between the operator and the contracted organisation clearly defining the contracted activities and the applicable requirements.

(c) The contracted safety-related activities relevant to the agreement should be included in the operator's safety management and compliance monitoring programmes.

(d) The operator should ensure that the contracted organisation has the necessary authorisation or approval when required, and commands the resources and competence to undertake the task.

GM1 ORO.GEN.205 Contracted activities

CONTRACTING — GENERAL

(a) Operators may decide to contract certain activities to external organisations for the provision of services related to areas such as:

(1) ground de-icing/anti-icing;

(2) ground handling;

(3) flight support (including performance calculations, flight planning, navigation database and dispatch);

(4) training; and

(5) manual preparation.

(b) Contracted activities include all activities within the operator’s scope of approval that are performed by another organisation either itself certified or authorised to carry out such activity or if not certified or authorised, working under the operator’s approval.

(c) The ultimate responsibility for the product or service provided by external organisations should always remain with the operator.

GM2 ORO.GEN.205 Contracted activities

RESPONSIBILITY WHEN CONTRACTING ACTIVITIES

(a) Regardless of the approval status of the contracted organisation, the contracting operator is responsible for ensuring that all contracted activities are subject to hazard identification and risk management, as required by ORO.GEN.200 (a)(3), and to compliance monitoring, as required by ORO.GEN.200 (a)(6).

(b) When the contracted organisation is itself certified or authorised to carry out the contracted activities, the operator’s compliance monitoring should at least check that the approval effectively covers the contracted activities and that it is still valid.

Na kraju želimo da dodamo da bi takva organizacija trebala da angažuje zaista iskusne stručnjake sa odgovarajućim tehničkim resursima, jer bi u sklopu svog domena rada imala odgovornost i za praćenje planiranih letova, zatim re-planning i druge aktivnosti. A ne treba da se zanemari opcija ugovaranja usluga sa više operatera pri čemu bi se značajno komplikovalo pružanje usluga za koje ste zainteresovani.
